Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of Qbit, operated by Hill Country Ranch LLC ("Qbit," "we," "us"). It is incorporated into and forms part of the Qbit Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service.

You are responsible for everything published through your account — including by anyone you invite to your team — and for every destination a QR code you create points to, whenever it points there.

1. Prohibited content

You may not use Qbit to create, publish, host, link to, or redirect to content that:

Deceives or defrauds

Impersonates any person, business, brand, government body, or organization, or falsely suggests affiliation, sponsorship, or endorsement
Imitates a login page, payment page, account verification page, or other interface of a third party
Solicits passwords, payment card numbers, bank details, government identification numbers, one-time codes, or cryptocurrency wallet credentials
Makes false or misleading claims about goods, services, prices, offers, or the identity of the seller
Promotes fraudulent, deceptive, or manipulative financial schemes

Is unlawful or harmful

Violates any applicable law or regulation
Sexually exploits or endangers minors, or sexualizes a minor in any way
Depicts or promotes violence, terrorism, or violent extremism, or incites others toward it
Harasses, threatens, defames, or targets any person, or discloses private information without consent
Promotes hatred or discrimination against people on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age, or veteran status
Encourages self-harm, suicide, or disordered eating

Infringes or misappropriates

Infringes copyright, trademark, patent, trade secret, publicity, or other proprietary rights
Uses another party's brand assets, logos, or trade dress in a way likely to confuse

Is regulated or restricted

Offers goods or services you are not licensed or permitted to offer, including regulated financial services, gambling, pharmaceuticals, controlled substances, weapons, tobacco, or vaping products, where doing so is unlawful in the jurisdiction where the content is accessible
Distributes adult sexual content without appropriate age verification and legal compliance, or at all where prohibited by law

Is malicious

Distributes malware, spyware, ransomware, or other harmful code
Redirects to sites that attempt drive-by downloads or browser exploitation
Facilitates unauthorized access to any system, account, or network

2. Prohibited conduct

You may not:

Redirect a QR code, after distribution, to any destination that violates this policy — including by changing a previously compliant code
Distribute QR codes by affixing, replacing, or obscuring codes or signage in physical locations without the property owner's permission, including on parking meters, payment terminals, packages, vehicles, or public infrastructure
Circumvent plan limits, rate limits, or access controls, or use the Service through automated means beyond documented interfaces
Interfere with the Service's operation, security, or availability, including through denial-of-service attempts, load testing without permission, or probing for vulnerabilities outside a disclosed security research process
Resell, sublicense, or provide the Service to third parties except as expressly permitted
Send unsolicited bulk communications, or use the Service to support them
Misrepresent your identity or the identity of your business when registering
Use the Service where doing so would violate sanctions or export control laws applicable to you or to us

3. Forms and data collection

Where you collect information from your end users through Qbit forms, you are the controller of that data and you are responsible for its lawful collection. You may not use Qbit forms to collect:

Special category data as defined in Article 9 of the GDPR — data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, health, sex life or sexual orientation, or genetic or biometric data used to identify a person
Payment card numbers, CVV codes, or bank account credentials
Government identification numbers, including national identity numbers, Social Security numbers, passport numbers, or driver's license numbers
Login credentials for any service, including Qbit
Personal data from children under the applicable age of digital consent, without verified parental consent

You must give your end users a clear privacy notice explaining what you collect, why, and how to exercise their rights, and you must have a lawful basis for collecting it. Qbit acts as your processor for this data under our Data Processing Agreement.

4. Reporting abuse

Anyone — whether or not they are a Qbit customer — may report content published through Qbit that they believe violates this policy or is unlawful.

To help us act quickly, include:

The Qbit URL or a description of the QR code and where you encountered it
What you believe is wrong with it, in enough detail for us to assess it
Where you are reporting content as unlawful rather than as a policy breach, an explanation of why, and a statement that your report is accurate to the best of your knowledge
Your name and contact email, unless the report concerns child sexual abuse material or another offense where anonymity is appropriate

We review reports promptly and will confirm receipt where you have given us a contact address. If we take action, we will tell you what we decided.

If you are a Qbit customer and we act against your content, we will notify you of the decision, the reason for it, and the basis — whether this policy, a legal requirement, or a third-party notice. You may respond to support@qbit.codes and ask us to reconsider. We will review your response and let you know the outcome.

5. Enforcement

Where we identify a violation, we may:

Ask you to correct it within a stated period
Disable a specific page, QR code, or redirect
Restrict features on your account
Suspend or terminate your account
Preserve or disclose information where required by law or valid legal process
Report unlawful content to the appropriate authorities

We will normally give notice and an opportunity to fix the problem. We may act immediately and without prior notice where content appears to involve phishing, malware, impersonation, child sexual abuse material, an imminent risk of harm, or where we are required to act by law.

We aim to respond proportionately, and to restore access where a violation is corrected or where we determine on review that a report was mistaken. Suspension or termination under this policy does not entitle you to a refund of fees already paid.

Nothing here obligates us to monitor content. We do not review pages before publication, and we make no representation that content published through Qbit complies with this policy.

6. Security research

We welcome good-faith vulnerability reports at security@qbit.codes.

If you research in good faith — avoid accessing or modifying other users' data, avoid degrading the Service, give us reasonable time to fix an issue before disclosing it, and do not exploit a finding beyond what is needed to demonstrate it — we will not pursue action against you under this policy or our Terms of Service.

7. Changes

We may update this policy as the Service and the risks to it change. We will post the updated version here and update the date above. Material changes take effect 30 days after posting, or immediately where a change is needed to address a legal requirement or a security risk.
